Terms & Conditions of Holiday Letting with AMS Mt Buller

Payments
A deposit of 50% of the total cost of the accommodation booking, inclusive of all services (“Total Cost”), must be received within 3 working days of the reservation being made before a reservation can be confirmed. Failure to do so may result in the reservation being automatically cancelled without notice.
Final payment of the remaining 50% of the Total Cost must be received no later than 30 days prior to the arrival date. Failure to make the final payment on time will result in the booking being automatically cancelled without notice. Payment must be made in full, no part payments can be accepted and the payment must be made by the person whose name the booking is in. When payment is made by direct transfer from one account into another the payee must include the surname of the booking in the details and if possible dates of booking.
Any charge for services to you, not billed at the time of your confirmation will be added to your account for settlement and be charged to the same credit card used as security for bond purposes.
Cancellation fees will be charged in accordance with the Cancellation Conditions set out below. If the date on which the reservation is made or the date on which the deposit is otherwise due, is less than 30 days prior to the arrival date, immediate payment in full of the Total Cost is required at the time of making the reservation unless otherwise notified to you at the time the reservation is made.
Credit Cards
A 2.9% transaction fee applies on all credit card payments.
Cancellation Fees
Cancellation of a booking must be in writing and must be received by Apartment Management Services Mt Buller either by fax, post or email address stated at the end of these terms and conditions. Cancellation fees will be charged on confirmed bookings in accordance with the following Cancellation Conditions. Failure to make final payment on the due date will result in an automatic cancellation of the booking without notice and the following Cancellation Conditions will also apply. Deposits cannot be transferred between properties and will not be refunded or applied towards payments for any other properties unless agreed between Apartment Management Services Mt Buller and the guest.
Cancellation Policy
Bookings cancelled more than 90 days prior to the arrival date are subject to a cancellation fee of $100. Bookings cancelled 30 to 90 days prior to the arrival date will incur a cancellation fee of 25% of the Total Cost. For those bookings cancelled less than 30 days prior to the arrival date, a cancellation fee of 100% of the Total Cost will be incurred (that is, there will be no refund).
Amendments
Apartment Management Services Mt Buller reserves the right to charge a $75 amendment fee for booking changes. An amendment to your booking is at the discretion of Apartment Management Services Mt Buller and is possible where one date of the booking remains the same and the length of stay remains the same. In the event you wish to vary the booking by changing to different premises this will be treated as a cancellation, unless otherwise agreed between Apartment Management Services Mt Buller and the guest.
Security Bond
A bond of between $1000 to $2000 applies on all properties. A Digital Registration form will be provided two calendar weeks prior to your arrival and is required to be completed with details of a valid credit card before occupation is allowed. Failure to complete the Digital Registration prior to your arrival will incur a $50 fee.  To ensure your bond is not compromised, please check the following guidelines:
* Remove and dispose of unwanted items from your refrigerator.  Place all rubbish and bottles in garbage sheds provided near your accommodation.  Rubbish and/or bottles not removed, will incur extra cleaning charges and will be charged a minimum of $70, plus $65 per hour thereafter.
* Depart your apartment no later than 10.00am, unless alternative arrangements for a late checkout have been made and paid for with AMS Mt Buller prior to your day of departure. Delays to cleaning staff due to late checkout will be charged at a minimum of $200.
* Leave the apartment in an acceptable condition, clean any excess spills or cooking mess. Wash any dishes, pots and pans and put them away neatly in the cupboards or ensure that the dishwasher has been turned on.
* Respect this property as if it were your own, no muddy boots and please take care of the furniture and fittings.
* Please check all rooms, bathrooms, cupboards, drawers, and under beds for any personal belongings.  Check that you have collected all your electronic chargers from the power sockets.  The return of lost property will be at your own expense.
* Return all keys given to you and leave all keys on the kitchen bench when departing – Lost keys $100 fee per key.
Should there be any damage to the apartment, articles therein, missing items, or excess cleaning due to the apartment being left in an unacceptable state, these monies will be deducted from your credit card provided as security bond.
Snow Guarantee
The Snow Guarantee gives you a money back guarantee on all pre-paid accommodation, lift ticket and lesson packages booked on your behalf by AMS Mt Buller in the event that insufficient snow cover prevents the Snow Guarantee lifts from operating within two days of your scheduled arrival date.   Please read the Snow Guarantee on the Mt Buller Website so that you fully understand the terms and conditions of the Snow Guarantee. If you choose to cancel under the guidelines of the Snow Guarantee, there is a 25% cancellation fee of the Total Cost of your reservation.  This 25% cancellation fee will be held and transferred to any future booking during the current season or may also be honoured for any booking for the next year’s season (at the discretion of AMS Management).
Weather Conditions
Under no circumstances can AMS Mt Buller or any of the property owners be held responsible for snow or weather conditions and cancellations made thereafter. Reservations cannot be cancelled other than in accordance with the cancellation policy detailed in this document or that fall under the Snow Guarantee (cancellation fee of 25% of the total cost).
Changes, Responsibility and Further Conditions
All information in respect of goods and services offered, including prices, is subject to alteration or withdrawal without notice. Apartment Management Services Mt Buller have the right to alter, amend or cancel all or any arrangements or prices in regard to accommodation. The right to alter prices referred to in the preceding paragraph applies until Apartment Management Services Mt Buller has received a deposit. During winter, midweek stays are Sunday to Thursday nights. Weekends are Friday and Saturday nights and are not sold separately.
In providing booking services Apartment Management Services Mt Buller ABN: 18 674 571 341 acts as an agent for various property owners. Apartment Management Services Mt Buller does not accept or undertake any personal liability when acting in this capacity.
Premises are let for holiday purposes only for the period stated on your booking confirmation by Apartment Management Services Mt Buller but may be subject to change as may be notified by the owner prior to the commencement of the booking. All advance deposits are accepted on behalf of the current owner, however we will not accept responsibility for decisions, actions or arrangements taken by the current owners of the premises or any other body which is outside our control.
Apartment Management Services Mt Buller reserves the right to cancel any booking should anything arise, which in our opinion absolutely renders the booking impractical. In either event, we shall notify you as soon a possible and do our best to arrange alternative accommodation or alternative suitable dates, failing which all deposit monies paid will be refunded, but no other claim, right or action shall exist in or be made by either party.
It is our aim at all times to get our clients into their accommodation as soon as possible on the day of their arrival. During winter however the premises are available from 4.00pm. The premises are to be vacated SHARP at 10.00am on the day of departure. The purpose of these strict times is to allow the necessary time to clean the premises. Please consider your fellow incoming/outgoing holiday occupants. We cannot allow access for the storage of any items prior to your check in time. Failure to depart before 10:00am on the day of departure will incur a minimum charge of $200 ($75 per hour after) if a late check-out has not been previously arranged with Apartment Management Services Mt Buller.
All damage, breakages or losses to the property and/or furniture/furnishings are to be reported to the Apartment Management Services Mt Buller and paid for immediately. All furnishings and equipment must be left in the premises as originally found. All properties have a strict NO SMOKING Policy.
Functions and parties on the premises are strictly not allowed.  Apartment Management Services Mt Buller reserves the right to terminate your tenancy immediately if you cause nuisance or annoyance to neighbours or are found to be holding a function or party.
Unless stated within the property description, all premises are fully self-contained including linen i.e. sheets, pillowcases, towels, bath mats, tea towels and do not provide an internet connection. The premises are not serviced during your stay, unless otherwise arranged.  Stays of more than 7 days will be serviced weekly. Given the extreme weather conditions experienced at Mt Buller, service outages are often and are no responsibility of the Owner or Manager of the property.
The maximum number of persons permitted to occupy the booked premises will form part of the booking contract and will be nominated when you make your booking. Persons found occupying the premises over and above the number on the booking form will be charged automatically to the security deposit at $500 a day for the term of the booking.
You are required to allow repair and or service personal to enter the premises for the purpose of conducting any repair or service deemed necessary by Apartment Management Services Mt Buller. Such times of entering will be arranged prior where possible and will be between the hours of 9:00 AM and 5:00 PM. All persons should be aware that Mt Buller is located within a remote area of the North East region of country Victoria. This logistically can sometimes create difficulties in locating parts and suitable persons for the repair and maintenance of some items within the property you have rented. Apartment Management Services Mt Buller at all times will do it’s very best to remedy items that are not operational in a reasonable timeframe. Apartment Management Services Mt Buller and/or the property owner takes no responsibility for delays in the repair that are outside it’s control.
No responsibility or liability is accepted or undertaken by Apartment Management Services Mt Buller, its employees, agents or contractors for any death, injury, accident, damage to personal property (including baggage) or any other matter arising from any act, omission or thing outside of their control.
In addition to the terms and conditions set out above, any booking is subject to such further terms and conditions as advised at the time of booking or as may be displayed at the time of utilisation of the item or service.  Any provision of, or the application of any provision of, these term and conditions which is void, illegal or unenforceable in any jurisdiction does not affect the validity, legality or enforceability of that provision in any other jurisdiction or of the remaining provisions in that or any other jurisdiction.
Privacy
Apartment Management Services Mt Buller is dedicated to keeping your details private. Any information we collect in relation to you, is kept strictly secured. We do not pass on/sell/swap any of your personal details with anyone. We use this information to identify your orders and to personalise your shopping experience with us; that is all.
Security Policy
When purchasing from Apartment Management Services Mt Buller your financial details are passed through a secure server using the latest 128-bit SSL (secure sockets layer) encryption technology.128-bit SSL encryption is approximated to take at least one trillion years to break, and is the industry standard.
Pricing Policy
Apartment Management Services Mt Buller prices are in Australian dollars (AUD).
Insurance
Apartment Management Services Mt Buller recommends you obtain travel insurance. This insurance can protect you against loss of personal belongings, public liability and also in the instance where you need to cancel under certain conditions not covered by the Snow Guarantee.
